United States citizens and permanent residents are entitled to seek immigration benefits, such as permanent resident status, for their children. A child, for immigration purposes, is an unmarried person under twenty-one years of age and includes:
- A child born in wedlock;
- A stepchild, provided the child was under age eighteen at the time the marriage creating the status of stepchild occurred;
- A child legitimated under the law of the child's or father's residence or domicile, provided:
- the legitimization takes place before the child's eighteenth birthday and
- the child is in the legal custody of the legitimating parent or parents at the time of such legitimization;
- A child born out of wedlock, by, through whom, or on whose behalf a status, privilege, or benefit is sought by virtue of the relationship of the child to its natural mother or to its natural father if the father has or had a bona fide parent-child relationship with the person;
- An adopted child provided:
- the adoption was completed before the child’s sixteenth birthday,
- the parent or parents have accumulated two years of legal custody, and
- the child and the adopting the parent or parents have resided together for at least two years; or
- An orphan child.
