H-1B Visa and Trade NAFTA (TN) Professionals
H-1B employment authorization is available to "professionals" or those with "preeminent" skills and abilities. This authorization is available upon petition by a U.S. employer for recognition by the Citizenship and Immigration Service of the need for professional service, or service from one with the preeminent skills.
A "professional" is defined as one whose occupation, as a matter of course both in regard to the individual employer's practice as well as the "industry" as a whole, dictates that he or she possess at least a baccalaureate degree or equivalent to perform the duties of the position in question.
A "prominent" individual is one whose achievements and/or skills have gained national or international recognition as being substantially above that ordinarily encountered.
A TN (Trade NAFTA work visa) is similar to the H-1B but is limited to a specific list of occupations and Canadian and Mexican nationals.
