Asylum Applications

An application for asylum may only be filed by those physically present in the United States and those applying for admission into the United States.

Individuals already Stateside however must file an application for asylum within one year of arrival. There are exceptions to this one-year limitation. If it can be demonstrated that exceptional circumstance precluded filing within a year of arrival an application can be filed. One obvious exceptional circumstance would be a change in conditions in the home country giving rise to the need for asylum where one did not previously exist.

An application for asylum will be granted upon demonstrating that it is not safe to return home because:

  • The applicant has a fear of persecution;
  • The fear is well-founded; and
  • The persecution is on account of race, religion, nationality, membership in a particular social group, or political opinion.

An application for asylum will not be granted regardless of the above if:

  • There is another country the applicant can be safely removed to.
  • A previous asylum application has already been denied.
  • The applicant has participated in the persecution of others.
  • The applicant has been convicted of a particularly serious crime and constitutes a danger to the community of the United States.
  • If there are serious reasons to believe that the applicant committed a serious nonpolitical crime outside the United States.
  • If there are reasonable grounds for regarding the applicant as a danger to the security of the United States.
  • If the applicant is inadmissible because of specified terrorist activities and is a continuing danger to the security of the United States.
  • If the applicant was firmly resettled in another country before arriving in the Untied States.

Once asylum has been granted, the asylee may thereafter apply for U.S. resident status once a year has passed from the date the asylum application was granted.
